Criminal Appeals

Have you or a loved one been convicted of a crime?
A defendant who has been convicted of a crime may have the right to appeal their conviction and sentence. The right to appeal may also be extended to those defendants who have plead guilty.
A defendant has 30 days to file their Notice of Appeal after they have been sentenced. These deadlines are very strict, so it is important to begin the process immediately.
The appeal is the next stage in the legal process after a trial where a defendant believes that an error was committed by the lower court, prosecuting attorney or defense attorney at any time during the proceedings.
Possible issues that may be raised in an appeal of a criminal conviction, include, but are not limited to:
- Mistakes in the trial process
- Error in allowance of certain evidence
- Violation of the defendant’s constitutional rights
- Defendant’s denial of their right to effective assistance of counsel
- Harsh and excessive sentence
