Commercial Drivers
The criminal defense attorneys at Tully Rinckey PLLC are experienced in handling offenses involving commercial drivers. We serve the Capital District area including Albany, Saratoga, Schenectady, and Troy.
Commercial drivers, or drivers holding a Commercial Driver License (CDL), are held to more stringent standards than regular drivers. CDL holders convicted of an alcohol and/or drug-related offenses are no longer eligible for conditional licenses.
Commercial drivers who refuse to take a chemical test can have their license revoked for at least 18 months and must pay a $550 civil penalty in order to apply for a new license. Additionally, commercial drivers who are repeat offenders of alcohol and drug-related offenses, including chemical test refusals, can face permanent license revocation.
