Were the sobriety tests conducted properly?
There are strict rules that govern the administration of sobriety tests. At Tully Rinckey, we will ensure that the proper steps were followed when you were given these tests. If there is anything that was wrong with the way these tests were conducted, our attorneys will use that mistake in your defense.
Was the timeframe for testing met?
Among the rules for conducting a BAC test is a very strict and limited timeframe, ranging from 20 minutes of observation and lasting only up to 2 hours time from when you are originally stopped. If this timeframe is off, even by a few minutes, it can be used in your defense against the charges
Was the original traffic stop legal?
Why were you pulled over in the first place? This can be an important piece of information in your defense. The reason for your stop can lead to the legality of that stop. Were you swerving? Speeding? If there is no cause for the stop, it is one more weapon in your defense arsenal at trial or during negotiations with the District Attorney.
There are many other variables that may have affected the outcome of the sobriety tests and therefore the charge itself. It is important to provide your attorney with as much detailed information as possible about the arrest. The smallest piece of information may seem insignificant to you, but can have a profound effect on your case.
