Underage Offenders

New York State maintains a strict Zero Tolerance Law against underage alcohol and/or drug-related offenses. This means those under the age of 21 facing alcohol and/or drug-related charges can be subjected to harsh consequences.
- An underage driver can face legal consequences by having a BAC of .02 to .07. A violation of the Zero Tolerance Law can result in license suspension for up to 6 months, a $125 civil penalty, and $100 suspension termination fee.
- Underage offenders that are charged with an alcohol and/or drug related offense under §1192 of the Vehicle and Traffic Law will be subject to a one-year license revocation.
- Repeat underage offenders will be subject to either a one-year license revocation, or a license revocation until they reach the age of 21, whichever is longer.
- An underage driver who refuses a chemical test during the five years after an alcohol and/or drug-related offense will have their license revoked for at least one year or until the age of 21, whichever is longer, and must also pay a $750 civil penalty in order to apply for a new license.
