Probate

Probate is the process where the will of a person who passed away is filed with the Surrogate’s Court with other required papers. The Surrogate’s Court will then grant a decree declaring that it was, in fact, the person’s valid Last Will and Testament and giving the named Executor the authority to act on behalf of the estate.
The probate process can be complicated with numerous legal requirements. For example, petitions, inventories, and accountings need to be filed. Negotiations with creditors may occur. Tax returns may need to be filed. Finally, assets may need to be sold and ultimately will need to be distributed properly and timely to beneficiaries. Therefore, it is a good idea to seek the assistance of an experienced attorney in this area.
